TERMS & CONDITIONS

The client agrees to read the terms and conditions carefully and to take full note of them. The following General Terms and Conditions apply to all commissioned assignments. They are deemed accepted unless expressly objected to without delay.

 

 

General Provisions​

The subject of the contract is the professional service provided by the make-up artist for the contractually agreed purpose. A contractual relationship is established exclusively between the make-up artist and the client.

 

Unless otherwise stated on the invoice, the invoice amount is payable within 7 days of the invoice or voucher being issued. No discounts will be granted.

Appointment Bookings​

A booking constitutes a binding assignment for both the make-up artist and the client. The booking becomes effective upon written confirmation of the assignment by the make-up artist to the client.

​

In the event of a booking, the make-up artist is entitled to the full agreed fee even if the assignment is not carried out, or not carried out to the agreed extent, for reasons beyond the make-up artist’s control — unless the cancellation is communicated in writing or by phone at least 10 business days prior to the scheduled appointment (a different policy applies for bridal stylings; see below).

The make-up artist can be booked either for the offered packages (at fixed flat rates) or for individual services on an hourly or daily basis (8 hours). The applicable hourly and daily rates can be found in the price list. Therefore, flat fees, hourly, or daily rates apply. Any working time that exceeds the booked period will be charged additionally according to the rates listed in the price list.

Third-Party and Additional Costs​

For fixed bookings in the B2B sector, the client is responsible for covering any incurred third-party and additional costs (e.g., material costs, props, styling expenses, as well as travel and accommodation costs and expenses for assignments outside the make-up artist’s place of residence) in accordance with tax regulations. If the original assignment is expanded, the make-up artist is entitled to separately invoice any additional services provided as well as any incurred third-party and additional costs.

Travel​

If domestic travel requires arrival the day before, or if the travel time to and from the production location exceeds 3 hours per day, or if the production location is outside of Germany, travel days will—unless otherwise agreed—be billed based on the time involved. The applicable hourly and daily rates listed in the price list serve as the basis for this calculation.

Creative Direction​

The client or their authorized representative is required to be present during the shoot/production and to approve the creative direction of the Make-up Artist. If neither the client nor an authorized representative is present during the shoot/production, the artistic design of the work cannot be rejected at a later date. In such cases, any creation of a new work must be compensated separately.

Any complaints regarding the Make-up Artist’s performance must be raised by the client immediately during the ongoing production, specifying the exact issues. Failure to do so will be deemed as acceptance of the service as agreed.

Fees​

The Make-up Artist’s fee covers only the services and contractual purposes agreed upon at the time of contract conclusion. Any use of the Make-up Artist’s services before full payment of the fee and any incidental or third-party costs is prohibited.

Termination of the contract, whether by withdrawal or cancellation, is only possible for good cause in the case of fixed bookings.

 

If an already started assignment is not completed, or if the client cancels the assignment less than 10 days before the agreed date without fault on the part of the Make-up Artist, the agreed fee as well as any incurred incidental and third-party costs must be paid in full.

Bridal Stylings​

The contract for bridal styling is concluded through a binding appointment reservation by the client (written appointment confirmation by the Make-up Artist) and the associated deposit. The contract covers all services specified in the booked bridal package as well as any additional services subsequently booked verbally, by phone, or in writing. These services include bridal make-up and bridal hairstyle (and possibly the application of false eyelashes), as well as, if agreed, additional hairstyling and/or make-up for other persons.

Communication takes place via common channels such as telephone, email, Messenger (Facebook/Instagram), or WhatsApp.

​

Prices for stylings can be found in the currently valid price list. Additional costs are charged at € 0.70 per kilometer traveled. No travel costs apply within a radius of 5 km from the stylist’s business address. Additional stylings are also charged separately. The remaining balance, including all other costs, must be transferred no later than 7 days after the wedding date. In case of cancellation of the agreed order including all agreed additional services by the client, the following cancellation fees apply:

  • Cancellation up to 3 months prior: 25% of the order value

  • Cancellation up to 2 months prior: 50% of the order value

  • Cancellation up to 10 days prior: 75% of the order value

  • Cancellation less than 10 days prior: 100% of the order value

This scale applies starting 3 months before the wedding date. In these cases, the amounts are due immediately upon cancellation. If a trial appointment has already taken place before cancellation, the deposit is non-refundable due to the work already performed. By booking the services, a fixed time slot is reserved for the bride, which is no longer available to other clients. Furthermore, in most cases, it is unfortunately not possible to reassign this time slot at short notice after cancellation.

Should the Make-up Artist be unable to perform her services due to illness or circumstances beyond her control, she will make every effort to find an adequate replacement. The Make-up Artist is not liable for any resulting damages.

​

The Make-up Artist may withdraw from an agreed contract at any time without stating reasons.

​

If the service is defective, this must be reported immediately and directly after the respective styling and only by the bride herself, to give the Make-up Artist the opportunity to make corrections to the client’s satisfaction. Later complaints and refund claims are invalid.

TfP/Test Shoots​

The following special conditions apply to so-called TfP (Time for Prints) or test shoots: If the Make-up Artist receives no or only a very small fee for their participation in a TfP/test shoot (use only for self-promotion), but the photographs or other materials created during the shoot are later used for other purposes, e.g., layout purposes or in advertising campaigns, the Make-up Artist is entitled to an additional reasonable fee. The reasonableness of this fee is based on the typical artist’s fee paid for such usage and the revenue generated by the client. Services provided by the Make-up Artist during a TfP/test shoot or filming may only be used for testing purposes or for self-promotion by the involved service providers (model, photographer, etc.).

Without the explicit consent of the Make-up Artist, the works/results created during the aforementioned shoots or filming may not be made available, either in whole or in part, to third parties for use (reproduction, distribution, publication, including by third parties). In the case of further use, the Make-up Artist’s services must be remunerated separately. Furthermore, when using the resulting images on any social media platforms (especially Instagram), it is mandatory to tag or mention the Make-up Artist.

Liability​

All products from Make-Up by SarahLena are dermatologically tested. However, the compatibility of the products cannot be guaranteed. If the client is aware of any allergies or sensitivities and owns their own makeup products tailored to them, it is advisable to use those. In such cases, the client is obliged to inform the Make-up Artist in advance. Liability for other damages arising from the fulfillment of the contract is only assumed in cases of intentional misconduct.

Attribution​

The Make-up Artist has the right to be named as the creator when their work is used beyond private use (including TfP/test shoots and editorials). The client ensures that this provision is implemented in their contracts with third parties.

​

Limitation Period​

All contractual claims by the client against the Make-up Artist expire within one year from the statutory start of the limitation period. Claims for damages resulting from injury to life, body, or health, as well as claims arising from grossly negligent or intentional breaches of duty, remain unaffected.

​

Use of Visual Material​

With the written consent of the client, the Make-up Artist is authorized to use photographs, films, analog and digital media (and copies thereof), for which they provided services, for self-promotion (social media, website, flyers, etc.). In this case, the client guarantees that the depicted model(s) consent to this use by the Make-up Artist.

​

​

Severability Clause

​Side agreements or agreements deviating from these terms require written form. Should any provision of the contract or these terms be invalid, this shall not affect the validity of the remaining provisions and the contract. Instead of an invalid provision, what most closely achieves the intended purpose shall be deemed agreed. The same applies to filling gaps in the contract.
